Which ITR form is yours?

Filing the wrong form = defective return notice u/s 139(9). Most salaried are ITR-1 or ITR-2. Business/professional income needs ITR-3 or ITR-4. Here's a decoder.

ITR-1

Sahaj — Salaried, simple

For resident individuals with salary/pension income up to ₹50 lakh, up to 2 house properties, and small LTCG (Section 112A) up to ₹1.25 lakh.

  • Salary + interest only
  • Up to 2 house properties
  • Total income ≤ ₹50L
  • Small equity LTCG ≤ ₹1.25L
ITR-2

Individuals & HUFs, no business

For those with capital gains, foreign income/assets, income above ₹50 lakh, or company directors — but no business or professional income.

  • Capital gains (property, unlisted, crypto)
  • Salary > ₹50L
  • Foreign income or assets
  • Company director / unlisted shares
ITR-3

Business or profession income

For individuals and HUFs earning from business or profession with regular books of accounts. Traders, doctors, lawyers, consultants, freelancers > ₹75L receipts.

  • Traders / F&O with books
  • Doctors, lawyers, CAs in practice
  • Freelancers > ₹75L receipts
  • Business turnover > ₹3Cr
ITR-4

Sugam — Presumptive taxation

For resident individuals, HUFs, and firms opting for presumptive taxation under Sec 44AD (business), 44ADA (profession), or 44AE (transport).

  • Small business ≤ ₹3Cr (44AD)
  • Professionals ≤ ₹75L (44ADA)
  • Transport ≤ 10 vehicles (44AE)
  • Simplified compliance

Understand the basics

What is Income Tax Return filing?

In one line: an annual declaration to the Income Tax Department showing your total income from all sources, tax already paid (TDS), deductions claimed, and either the refund due to you or additional tax payable.

Income Tax Return (ITR) is a form you file with the Income Tax Department every year, summing up all your income during the previous financial year (FY 2025-26 for AY 2026-27) and computing your final tax liability. It's how the government reconciles the TDS deducted from your salary, FDs, and other sources against your actual tax liability based on slabs and deductions.

Filing is mandatory if your gross total income exceeds ₹4 lakh under the new regime (default), ₹2.5 lakh under the old regime. It's also mandatory regardless of income if you have foreign assets, high-value transactions (property, foreign travel, credit card > ₹10L), or need to claim a refund.

Beyond compliance, ITR is your single strongest proof of income — needed for home loans, business loans, visas, credit cards, insurance underwriting, and government tenders. Three years of clean ITRs open doors that no other document does.

SALARY Form 16 HOUSE Rent CAPITAL Gains BUSINESS P&L OTHER Interest GROSS TOTAL INCOME Sum of all income heads − deductions APPLY SLABS Tax Liability new regime · old regime − TDS + rebate IF TDS > TAX Refund to your bank in 30-45 days IF TAX > TDS Pay Balance via challan before filing

File ITR if you're...

  • Your total income is above ₹4 lakh (new regime basic exemption)
  • You have any TDS deducted — filing gets you the refund
  • You want to apply for a home loan, visa, or credit card
  • You need to claim a refund on excess tax paid
  • You have capital gains from shares, crypto, mutual funds, or property
  • You want to carry forward losses (must file by due date)
Why filing pays off

6 real benefits of filing ITR — beyond "avoiding a notice"

Most filers focus on compliance. Smart filers use their ITR as leverage — for refunds, loans, visas, and legal proof.

Get Your Refund

If TDS was deducted from your salary or FDs, filing ITR is the only way to claim the excess back. Average salaried refund: ₹15,000–₹40,000. Delayed refunds earn 6% interest u/s 244A.

Legal Proof of Income

ITR acknowledgement is the strongest single document proving your income — accepted by banks, embassies, insurance companies, and courts for years to come.

Loans & Visa

Home loans, personal loans, business loans, and Schengen/US/UK visas mandatorily require 2–3 years of ITR. No ITR = no loan, no visa. Simple as that.

Carry Forward Losses

F&O losses, capital losses, business losses — carry forward up to 8 years to offset future gains. But only if you file by the due date. Miss it = lose the benefit forever.

Avoid Notices

AIS + 26AS now capture every high-value transaction (property, mutual funds, credit card spend, foreign travel). Not filing when income shows up = automatic scrutiny notice.

Government Tenders

GeM registrations, PSU tenders, and most govt schemes require 3 years of filed ITRs. No filing history = ineligible to bid, regardless of your business quality.

Avoid these traps

6 common ITR mistakes — and how to avoid them

In 10+ years of ITR practice, these are the top blunders we've fixed for clients. Any one of them can cost you ₹20k-₹10L.

Mistake #1

Choosing the wrong regime blindly

New regime is default. But if you claim HRA, 80C, home loan interest, LTA totaling > ₹4.25L on ₹15L salary, old regime saves more. Wrong choice = ₹20-60k extra tax.

Fix: Compute both regimes side-by-side before filing. We do this by default.
Mistake #2

Missing AIS/26AS reconciliation

AIS captures every mutual fund redemption, credit card spend > ₹10L, share sales, foreign travel, high-value FDs. Not reporting = automatic notice u/s 143(2) or 148.

Fix: Download AIS + TIS + 26AS first. Report every high-value item, even if TDS was already deducted.
Mistake #3

Filing ITR-1 when ITR-2 is required

Sold one mutual fund unit above ₹1.25L in gains? ITR-1 disallowed, must file ITR-2. Wrong form = defective return notice u/s 139(9) — 15 days to fix or return treated as never filed.

Fix: Check your capital gains + foreign income + director status before picking form.
Mistake #4

Not reporting foreign assets

Any foreign asset (US stocks, ESOPs of foreign parent, PayPal wallet, foreign bank) must be reported in Schedule FA. Penalty for concealment: ₹10 lakh + prosecution under Black Money Act.

Fix: Report every foreign holding, even ₹100. Better safe than ₹10L fine.
Mistake #5

Not e-verifying within 30 days

Filed but forgot to e-verify? Return treated as invalid — as if you never filed. Losses can't be carried forward, refund forfeited, exposure to late-filing penalty resurfaces.

Fix: E-verify same day using Aadhaar OTP. Takes 30 seconds.
Mistake #6

Missing 31 July deadline (salaried)

Late fee ₹1,000 (income < ₹5L) or ₹5,000 (> ₹5L). Interest u/s 234A at 1% per month on unpaid tax. Lose carry-forward of losses. Reduced ability to revise later.

Fix: File by 15 July internal deadline. Rush at month-end = errors. Extension to 31 Aug for ITR-3/4 non-audit cases confirmed for AY 2026-27.

FAQ

Common questions

Straight answers. Still curious? WhatsApp us anything.

Who must file ITR in India?

Mandatory if your gross total income exceeds the basic exemption limit — ₹4 lakh under new regime (default), ₹2.5 lakh under old regime. Also mandatory regardless of income if you: (1) deposited > ₹1 crore in current account, (2) spent > ₹2 lakh on foreign travel, (3) paid > ₹1 lakh electricity bill, (4) have foreign assets, or (5) claim tax refund.

Which ITR form should I use?

Depends on your income mix. ITR-1: salary + interest, income ≤ ₹50L, up to 2 houses. ITR-2: capital gains, foreign, > ₹50L, director. ITR-3: business/profession with books. ITR-4: presumptive taxation (44AD/44ADA/44AE). See our 4-way ITR Form Selector above.

What is the last date to file ITR for AY 2026-27?

31 July 2026 — salaried, pensioners, and non-audit cases filing ITR-1 or ITR-2. 31 August 2026 — non-audit ITR-3/4 (deadline extended from 31 July). 31 October 2026 — audit cases. 30 November 2026 — transfer pricing cases.

Belated return: 31 December 2026. Updated return u/s 139(8A): up to 4 years back (until 31 March 2030 for AY 2026-27).

What is the difference between AY and FY?

Financial Year (FY) = year in which income is earned (1 April to 31 March). Assessment Year (AY) = year immediately following, when that income is assessed and ITR is filed. Income earned in FY 2025-26 (Apr 2025 - Mar 2026) is assessed in AY 2026-27.

Note: under Income Tax Act 2025 effective 1 April 2026, both terms merge into single "Tax Year" concept.

New regime vs old regime — which is better?

Depends entirely on your deductions. New regime wins if your total deductions (80C + 80D + HRA + home loan + LTA + NPS) are below ~₹4.25 lakh on ₹15L salary. Old regime wins if above.

For salaried without HRA and home loan, new regime almost always wins because zero tax up to ₹12.75L (₹75k std deduction + ₹12L rebate).

Rule of thumb: young salaried without dependents → new. Mid-career with home loan + HRA + PF + insurance → often old. We compute both automatically.

Is ₹12 lakh really tax-free in new regime?

Yes — for resident individuals with net taxable income up to ₹12 lakh. The Section 87A rebate of ₹60,000 exactly cancels the tax computed on income up to ₹12L under new-regime slabs. Result: zero tax.

Salaried get ₹75,000 standard deduction on top, so salary up to ₹12.75 lakh is effectively tax-free.

Caveat: LTCG under Section 112A and other special-rate income don't get the rebate — they're taxed separately at flat rates.

Can I switch regimes every year?

Salaried without business income: yes, switch freely every year by ticking the right box in ITR. Compare both, pick the better one.

Business income (ITR-3/4): you can opt OUT of new regime only ONCE. To re-enter old regime after switching, you can't go back to new regime again. Choose carefully with a CA.

What deductions are lost in the new regime?

Not allowed in new regime: 80C (LIC, PPF, ELSS), 80D (health insurance), 80DD, 80DDB, 80E (education loan), 80G (donations), HRA exemption, LTA exemption, home loan interest u/s 24(b) for self-occupied property, entertainment allowance, professional tax paid by employer.

Still allowed in new regime: standard deduction ₹75,000, employer NPS contribution u/s 80CCD(2), interest on let-out home loan (Section 24 limited to loss set-off).

How long does ITR filing take with you?

Simple ITR-1/4 salaried: same day from receipt of documents. Complex ITR-2/3 with capital gains, F&O, or foreign income: 2-4 days for full computation and review.

We share draft computation for your approval before filing. Once approved, filed and e-verified within 2 hours.

Do I need to visit your office?

No. Entire process is remote — WhatsApp, email, and portal. Physical presence not required.

How does e-verification work?

Four options: (1) Aadhaar OTP — instant, recommended, needs Aadhaar-linked mobile; (2) Net banking — via authorised banks; (3) EVC via bank a/c or Demat; (4) Physical ITR-V — sign and post to CPC Bengaluru within 30 days.

We handle e-verification for you the same day using Aadhaar OTP where possible.

When will I get my refund?

For simple ITR-1 salaried refunds: typically 7-30 days after e-verification. For complex returns or first-time filers: 30-90 days. Bank must be pre-validated on income tax portal.

Delayed refunds earn 6% p.a. interest u/s 244A from 1 April of AY (or date of filing if late). Track on portal or via our client dashboard.

What is the penalty for late filing?

Late fee u/s 234F: ₹1,000 if income ≤ ₹5L, ₹5,000 if income > ₹5L. Plus interest u/s 234A at 1% per month on unpaid tax from due date till actual filing.

Non-monetary consequences worse: (1) can't carry forward business/capital losses, (2) reduced ability to revise, (3) higher scrutiny probability, (4) delay in refund if applicable.

What if I don't file at all?

Best-case: notice u/s 142(1) asking you to file. Then late fee + interest apply. Worst-case: prosecution u/s 276CC — imprisonment 3 months to 7 years + fine if evaded tax > ₹25,000.

Department has AIS + 26AS + bank data — they know your income. Not filing is not hiding. Best to file even a nil return if you're on the borderline.

Missed the deadline — what to do?

File belated return u/s 139(4) by 31 December 2026 with late fee. If missed even that, file updated return u/s 139(8A) — allowed up to 4 years back with 25%/60% additional tax on the tax payable (progressive penalty).

Updated return can't claim refund or reduce tax — only add income. Regular filing is always cheaper.

What is intimation u/s 143(1)?

Automated intimation from CPC after processing your return. Three possibilities: (1) Accepted as filed — done; (2) Refund due — bank credit follows; (3) Demand raised — CPC found discrepancy vs 26AS/AIS, pay within 30 days or file rectification u/s 154.

If wrong: file rectification within 4 years. If correct: pay to avoid further interest at 1% per month.

I have F&O losses — what to do?

F&O is non-speculative business income — losses can be set off against any income (salary, capital gains, other) in same year. Unabsorbed loss carries forward 8 years, but only against future F&O gains.

Filing: ITR-3 mandatory. Audit u/s 44AB triggered if F&O turnover > ₹10Cr (with digital transactions > 95%) or > ₹1Cr otherwise. Books required.

Crypto tax — how is it treated?

Flat 30% tax on gains (no slab benefit, no deductions except acquisition cost). Plus 1% TDS u/s 194S on every transfer > ₹10,000/₹50,000 threshold. Losses cannot be set off against other income or carried forward.

Reported in Schedule VDA of ITR-2 or ITR-3. Every transaction must be reported — even loss-making ones. Non-reporting triggers automatic notice from AIS.

NRI — do I need to file?

NRIs must file if India-sourced income exceeds basic exemption (₹4L new regime). Types: rental from Indian property, capital gains on Indian assets, interest on NRO/FCNR, salary earned in India.

Form: ITR-2 mandatory (ITR-1 restricted to residents). Can claim DTAA benefits with treaty countries — often reduces TDS from 30% to 10-15%. We handle DTAA + Schedule FA for global-asset NRIs.

Presumptive taxation 44AD / 44ADA — worth it?

44AD (business): turnover ≤ ₹3Cr (with 95%+ digital), declare 6% (digital) or 8% (cash) as deemed profit. No books, no audit. Actual profit doesn't matter.

44ADA (profession): gross receipts ≤ ₹75L (with digital condition), declare 50% as deemed profit. Perfect for doctors, lawyers, CAs, consultants.

Once you opt in, you must continue for 5 years — opting out earlier locks you into books + audit for next 5 years. Choose wisely.
