What is FSSAI, and why every food business needs it
In one line: legally mandated food safety credential — without it, you cannot sell food, list on marketplaces, or defend against ₹5L penalty + imprisonment under Section 63.
FSSAI (Food Safety and Standards Authority of India) is the statutory regulator established under the Food Safety and Standards Act, 2006. An autonomous body under the Ministry of Health and Family Welfare, responsible for setting food safety standards and issuing licenses across India.
Under Section 31 of FSS Act 2006, no Food Business Operator (FBO) can manufacture, store, transport, distribute, or sell food without a valid FSSAI license or registration. Applications file via FoSCoS portal (foscos.fssai.gov.in) — the digital Food Safety Compliance System that replaced the older FLRS system in 2020.
2026 Amendment (game-changer): FSSAI Order dated 13 March 2026 (Gazette 10 March 2026), effective 1 April 2026, introduced:
- 12.5× threshold hike: Basic Registration now covers turnover up to ₹1.5 Cr (was ₹12L)
- Perpetual validity: no more 1-5 year renewals, subject to risk-based inspections
- Deemed FSSAI for street food vendors registered under Street Vendors Act 2014
- Food trucks/carts classified as Petty FBOs
Marketplace mandate: Swiggy, Zomato, Amazon Pantry, Blinkit, Zepto, BigBasket all auto-verify FSSAI 14-digit number during onboarding. No license = no listing.
Choose FSSAI if you...
- You sell any food/beverage — manufacture, retail, import, export, restaurant, cloud kitchen, home bakery, tiffin service, food truck
- You want to list on Swiggy / Zomato / Amazon Pantry / Blinkit — FSSAI number is mandatory
- You want perpetual validity under 2026 amendment — no more 1-5 year renewals (subject to risk-based inspections)
- You want Basic Registration under revised ₹1.5 Cr ceiling — 12.5× hike from old ₹12L limit
- You export food products — Central License mandatory regardless of turnover
- You want to avoid up to ₹5 lakh penalty + imprisonment under FSS Act 2006 Section 63
Skip FSSAI if you...
- You don't sell food or food-related products at all
- You're only a raw agricultural producer (unprocessed) — outside FSSAI scope
- You're a street food vendor registered under Street Vendors Act 2014 — you're deemed registered with FSSAI (2026 amendment, no separate filing)
- You're only in food-service R&D with no commercial sale — advisory-only setups fall outside
What FSSAI credentialing actually delivers
Every benefit tied to a specific section of FSS Act 2006 or 2026 Amendment — not marketing, statutory protection.
Legal Mandate under FSS Act 2006
Under Section 31 of the Food Safety and Standards Act, 2006, no food business can manufacture, store, transport, distribute, or sell food without FSSAI license/registration. Section 63 mandates penalty up to ₹5 lakh + imprisonment for non-compliance. This isn't optional — it's the foundational law that unlocks every other food business permission.
2026 Amendment · ₹1.5 Cr Basic Threshold
FSSAI Order dated 13 March 2026 (Gazette 10 March 2026), effective 1 April 2026, raised the Basic Registration turnover threshold from ₹12 lakh to ₹1.5 crore — a 12.5× hike. Many restaurants, cloud kitchens, and small manufacturers that would have needed State License now qualify for Basic (₹100/yr fee). Massive compliance relief.
Perpetual Validity (2026 amendment)
Under the FSS (Licensing and Registration) Amendment Regulations 2026, FSSAI registrations/licenses issued from 1 April 2026 have perpetual validity — no more 1-5 year expiry renewals. Subject to risk-based inspections by Food Safety Officers. Existing licenses continue on their current term; renewals switch to perpetual on next filing.
Swiggy · Zomato · Amazon Access
Marketplace platforms (Swiggy, Zomato, Amazon Pantry, Blinkit, Zepto, BigBasket) automatically verify FSSAI 14-digit number during onboarding. No FSSAI = no listing. Without listing, you can't sell to 500M+ Indian food consumers who order via apps. This is the digital-first mandate.
Tatkal (Fast-Track) for Basic
Small food businesses can now use the Tatkal instant option for Basic Registration on FoSCoS portal — 48-hour processing after fee payment and digital verification. Home bakeries, tiffin services, food trucks all eligible. Certificate issued digitally, downloadable immediately.
Street Vendor Deemed Registration
Under 2026 amendment, street food vendors registered under the Street Vendors Act 2014 with municipal corporations or vending committees are deemed registered with FSSAI — no separate filing needed. Benefits 10 lakh+ vendors. Must still follow FSSAI hygiene norms (Schedule 4). Formalises the sector.

FSSAI Threshold Revision — 12.5× hike explained
Order dated 13 March 2026 (Gazette 10 March 2026), effective 1 April 2026. Biggest FSSAI reform in over a decade.
From certificate to Annual Return — key milestones
4 critical dates. Tatkal 48hr certificate. Week 1 packaging deployment. Day 30 FSMS setup. 31 May annual return (State/Central only).
Tatkal certificate issued (Basic)
Basic Registration via Tatkal option issues certificate within 48 hours. Download 14-digit FSSAI number from FoSCoS portal. Start displaying on packaging + website + Swiggy/Zomato profile immediately. Deploy on all invoice templates.
State/Central take 30-90 days including inspectionUpdate all packaging + listings
FSSAI 14-digit number must appear on every product package, restaurant menu, food truck signage, cloud kitchen packaging, delivery bags, and marketplace listings. Missing FSSAI number = ₹2 lakh penalty per Section 55 FSS Act. Update Swiggy/Zomato profile immediately.
Marketplaces auto-delist non-compliant listingsFSMS deployment (State/Central)
Food Safety Management System (FSMS) plan must be in place for State/Central license holders. Includes Schedule 4 hygiene norms, CCP monitoring, staff training records, water/product testing schedule. Basic Registration exempt from formal FSMS.
Missing FSMS = inspection failure = suspensionAnnual Return Form D (State/Central)
State + Central license holders must file Annual Return in Form D by 31 May for previous financial year on FoSCoS portal. Includes food products manufactured, quantities, sales data. Basic Registration is exempt from Form D.
Missing May 31 deadline = ₹100/day penalty6 common FSSAI mistakes — and how to avoid them
The biggest: wrong Kind of Business selection. #1 rejection reason on FoSCoS portal. All preventable.
Wrong Kind of Business (KoB) selection
The #1 reason applications are reverted on FoSCoS. Restaurants selecting "manufacturer", retailers selecting "wholesaler", cloud kitchens selecting "caterer" — all cause reversal. FoSCoS has 100+ KoB codes with specific definitions. Wrong KoB also means wrong license tier + wrong fee + potential penalty.
Wrong license tier vs turnover
Under 2026 rules: Basic up to ₹1.5 Cr, State ₹1.5Cr-₹50Cr, Central above ₹50Cr. Businesses with ₹1 Cr turnover who applied for State License under old ₹12L rule are now over-licensed — pay 20-50× more fee than needed. Businesses who cross threshold mid-year face penalty for continued lower-tier.
Ignoring activity-based Central mandate
Some activities need Central License regardless of turnover: importers, exporters, e-commerce nationwide, multi-state vending machines, Central Govt supply, 100% export-oriented units, health supplement/nutraceutical manufacturers, proprietary food, infant food, packaged water. A ₹50L exporter still needs Central, not Basic.
Missing Annual Return (Form D)
State and Central license holders must file Form D by 31 May every year for previous FY. Includes products manufactured, quantities, sales data. Missing deadline = ₹100/day penalty. Compounding penalty for repeated defaults. Basic Registration is exempt.
Not displaying 14-digit FSSAI number
Section 55 FSS Act 2006 mandates FSSAI 14-digit number on every food product package, restaurant menu, food truck signage, delivery packaging, and marketplace listing. Missing = ₹2 lakh penalty. Marketplace platforms (Swiggy/Zomato) also auto-delist non-compliant listings.
Overlooking perpetual validity switch
Post 1 April 2026, licenses are perpetually valid. But existing 1-5 year licenses continue on their current term until renewal. Many FBOs assume old license is now perpetual — false. Only next renewal after 1 April 2026 switches to perpetual. Missing your current expiry = license lapse + fresh application penalty.

Food business compliance
The Tax Paramarsh desk
"FSSAI is where the entire food business compliance stack begins. Under Section 31 FSS Act 2006, you literally cannot operate a food business without it. The 2026 amendment was a huge win for small businesses — Basic Registration threshold jumped from ₹12 lakh to ₹1.5 crore. That means home bakeries, tiffin services, food trucks, small restaurants, and cloud kitchens up to ₹1.5 Cr turnover now pay ₹100/yr instead of ₹5,000/yr. Perpetual validity means no more renewal drama. Our 4-year mistake tracking shows: #1 rejection reason on FoSCoS is wrong Kind of Business selection. We map every client's primary + secondary activities against the 100+ KoB codes before filing. And for exporters — activity-based Central License mandate is easy to miss. A ₹50 lakh food exporter still needs Central, not Basic. That's the difference between form-filling and food business advisory."
What food business owners say after FSSAI with us
Common questions
Straight answers. Still curious? WhatsApp us anything.
What is FSSAI and what does it regulate?
FSSAI (Food Safety and Standards Authority of India) is the statutory regulator established under the Food Safety and Standards Act, 2006. Autonomous body under the Ministry of Health and Family Welfare.
What it regulates: All aspects of food safety in India — manufacture, storage, transport, distribution, sale, import, and export of food. Sets standards, issues licenses via FoSCoS portal, and inspects premises via Food Safety Officers.
License mandatory for: Restaurants, cloud kitchens, food manufacturers, importers, exporters, e-commerce sellers, wholesalers, retailers, dairy, food trucks, cafes, sweet shops, tiffin services, home bakers — anyone selling any food or beverage.
What changed in the 2026 amendment?
The FSS (Licensing and Registration of Food Businesses) Amendment Regulations, 2026 — notified in Gazette on 10 March 2026 with FSSAI Order dated 13 March 2026, effective 1 April 2026 — introduced 4 major changes:
- Revised turnover thresholds (see below)
- Perpetual validity — no more 1-5 year expiry renewals
- Deemed FSSAI registration for street food vendors registered under Street Vendors Act 2014
- Food trucks/carts explicitly classified as Petty FBOs
These are the biggest FSSAI reforms in over a decade.
What are the revised 2026 turnover thresholds?
Under FSSAI Order dated 13 March 2026, effective 1 April 2026:
- Basic Registration: Turnover up to ₹1.5 crore (was ₹12 lakh — 12.5× hike)
- State License: Turnover ₹1.5 crore to ₹50 crore (was ₹12L to ₹20 Cr)
- Central License: Turnover above ₹50 crore (was above ₹20 Cr)
Note: activity-based overrides still apply — importers, exporters, e-commerce nationwide, multi-state vending, Central Govt supply, and specific manufacturers (nutraceuticals, infant food, packaged water) need Central regardless of turnover.
What is FoSCoS and how does it work?
FoSCoS (Food Safety Compliance System) is the official digital portal at foscos.fssai.gov.in — replaced the older FLRS (Food Licensing and Registration System) in 2020. Single window for all FSSAI activities.
What you do on FoSCoS: Apply for new license/registration, renewals, modifications, annual return (Form D), inspection reports, product approval, license certificate download.
Payment: Net banking, debit/credit card, UPI. No offline applications accepted since 2020.
What are the total FSSAI costs for 2026?
Basic Registration: Our fee ₹1,000 + govt fee ₹100/yr (₹500 for 5-yr bulk) = ~₹2,199 all-in.
State License: Our fee ₹5,000 + govt fee ₹2,000-5,000/yr (activity-dependent) = ~₹7,000-10,000 all-in.
Central License: Our fee ₹15,000 + govt fee ₹7,500/yr = ~₹17,500 all-in.
+ GST @ 18% on our professional fee. Perpetual validity means no renewal fees under 2026 rules (subject to risk-based inspections).
Are there any hidden costs?
None from us. But be aware of:
- Water testing report ~₹1,500-3,000 (for manufacturers) — done at NABL-accredited lab
- FSMS plan drafting included in our State/Central tiers
- NOC from municipality for State/Central — usually ₹500-2,000 depending on locality
- Product testing lab charges for Central manufacturers — varies by product
These are third-party costs — we help coordinate but don't mark up.
What is the penalty for not having FSSAI?
Severe penalties under FSS Act 2006:
- Section 63: Selling food without license/registration — imprisonment up to 6 months + fine up to ₹5 lakh
- Section 55: Missing FSSAI number on packaging — ₹2 lakh per violation
- Section 62: Sub-standard food — up to ₹5 lakh
- Section 59: Unsafe food — up to life imprisonment + ₹10 lakh
Marketplace platforms (Swiggy, Zomato, Amazon) also auto-delist non-compliant listings. Insurance companies deny claims for uncompliant food businesses.
Do I need FSSAI to list on Swiggy/Zomato/Amazon?
Yes — absolutely mandatory. Marketplace platforms verify FSSAI 14-digit number during onboarding:
- Swiggy / Zomato — require FSSAI before restaurant listing goes live
- Amazon Pantry / Amazon Fresh — require FSSAI for food seller registration
- Blinkit / Zepto / BigBasket / Instamart — same requirement
- Meesho / Flipkart — food category listings need FSSAI
No FSSAI = no listing = no access to 500M+ Indian food consumers who order via apps. Digital-first mandate.
How long does FSSAI take in 2026?
Basic Registration: Tatkal option 48 hours (fast-track), regular 7-15 working days. Tatkal costs same government fee but our fee unchanged.
State License: 30-60 working days including mandatory pre-approval premises inspection by Food Safety Officer.
Central License: 60-90 working days. Inspection + product testing may be required.
Modifications: 15-30 working days.
Renewals (new perpetual regime): No renewals under 2026 rules for licenses issued after 1 April 2026.
When should I apply for FSSAI?
Before starting operations — Section 31 FSS Act prohibits food business without valid FSSAI. Application takes 48hrs-90 days depending on tier. Plan accordingly:
- Home bakery/tiffin/food truck: Apply 1 week before launch (Tatkal Basic 48hr)
- Restaurant/cloud kitchen: Apply 2 months before launch (State inspection needed)
- Manufacturer/importer: Apply 3 months before launch (Central + product testing)
Marketplace listings can't go live without FSSAI. Insurance requires FSSAI. Banks require FSSAI for food-business loans.
What happens during premises inspection?
For State + Central Licenses, Food Safety Officer visits your premises to verify:
- Compliance with Schedule 4 (Good Manufacturing Practices) — hygiene, sanitation, staff health
- Proper storage: raw materials, finished goods, chemicals, waste segregation
- Water quality (testing report required)
- Pest control records
- Staff medical fitness certificates
- Food Safety Management System (FSMS) documentation
Failure = second inspection scheduled. Repeat failure = application rejected. We do pre-inspection audit + prep so first inspection passes.
What is Perpetual Validity under 2026 rules?
Under FSS (Licensing and Registration) Amendment Regulations 2026, FSSAI registrations and licenses granted from 1 April 2026 onwards have no expiry date. Previously licenses were 1-5 year renewable.
Key conditions:
- Subject to risk-based inspections by Food Safety Officers — non-compliance can trigger suspension
- Existing pre-2026 licenses continue on current term until next renewal, then switch to perpetual
- Annual Return (Form D) still required for State/Central by 31 May every year
- FSSAI reserves right to specify categories requiring periodic renewal in future orders
What are Kind of Business (KoB) categories?
FoSCoS portal has 100+ KoB codes grouped by primary activity type:
- Petty FBOs: Home Based Food Business, Petty Retailer, Hawker, Food Truck / Cart (from 2026), Cottage Industry, Temporary Stall
- Manufacturing: Manufacturer, Re-labeller/Re-packer, 100% EOU, Nutraceutical, Proprietary Food, Infant Food
- Food Service: Restaurant, Cloud Kitchen, Catering, Canteen, Hotel, Dhaba, Sweet Shop, Bakery
- Trade: Wholesaler, Distributor, Retailer, E-commerce FBO
- Transport & Storage: Transporter, Cold Store, Warehouse
- Import/Export: Importer, Exporter
Correct KoB is critical — wrong KoB is the #1 rejection reason on FoSCoS.
What is Annual Return Form D?
Form D is the FSSAI Annual Return filed by State + Central license holders by 31 May every year for the previous financial year. Basic Registration is exempt.
Data required:
- Food products manufactured (category-wise)
- Quantity produced/imported (in MT or KL)
- Sales data (unit-wise + turnover)
- Stock summary
- Details of testing done (own lab or third-party)
Penalty: Missing 31 May deadline = ₹100/day per Regulation 2.1.13 of FSSR 2011. Compounding for repeated defaults.
Do I need FSSAI for exports?
Yes — Central License mandatory for all food exporters, regardless of turnover. Activity-based override under FSS Regulations 2011.
Reason: Central License is required for compliance with international standards, customs verification, and destination-country import requirements. Many countries (EU, US, GCC) verify Indian FSSAI Central License during import clearance.
Additional requirements for exporters:
- Import Export Code (IEC) from DGFT
- Product-specific export certificate (for meat, dairy, seafood, spices)
- APEDA/MPEDA/EIC certification (product-dependent)
- Country of destination approvals
Can I have multiple FSSAI licenses for multiple outlets?
Yes — each premises needs its own license. A restaurant chain with 6 outlets in Delhi + 4 in Mumbai needs 10 separate FSSAI State Licenses (State-specific).
Exceptions:
- Central License: One Central License covers multiple states operations for the same FBO (for importers, exporters, e-commerce, Central Govt supply). Individual premises still need State License if manufacturing on that premises.
- Warehouses: Each warehouse/cold store premises needs separate license.
We handle multi-location filings in parallel via FoSCoS — significantly cheaper than filing one-by-one.
What is FSMS and who needs it?
Food Safety Management System (FSMS) is a documented food safety plan required for State + Central License holders. Basic Registration exempt.
Components:
- Schedule 4 hygiene norms (GMP) implementation
- Critical Control Points (CCPs) identification per HACCP principles
- Standard Operating Procedures (SOPs) for cooking, storage, delivery
- Staff training records
- Water and product testing schedule
- Pest control + waste management
- Traceability system (batch-wise)
- Recall procedure
Our State/Central tier includes FSMS template + customization.
What is the Food Recall system (2026)?
FSSAI Order dated 18 March 2026 introduced Food Recall functionality on FoSCoS portal — mandatory reporting system for FBOs when unsafe food is detected in market. Applies to State + Central license holders.
Recall levels:
- Class I: Serious health hazard (immediate recall, media notification)
- Class II: Temporary health hazard (recall within 72 hours)
- Class III: Regulatory non-compliance without health hazard
Failure to initiate recall = penalty up to ₹5 lakh + license suspension. Our compliance retainer includes recall SOP + trigger monitoring.
What are E-commerce FBO obligations (2026)?
FSSAI Order dated 18 March 2026 on E-commerce Compliance under ONDC model — key obligations for online food sellers:
- Marketplace verification: Amazon/Swiggy/Zomato must verify FSSAI number before onboarding
- Delivery partner training: Food delivery partners must receive food safety training
- Temperature-controlled delivery: Cold chain integrity for perishables
- Complaint redressal: 48-hour response to consumer complaints
- Data sharing: Marketplace platforms share FBO data with FSSAI on request
E-commerce nationwide FBOs need Central License regardless of turnover.
Are there special rules for high-risk categories?
Yes — high-risk categories must comply with full hygiene/testing/safety requirements regardless of turnover thresholds:
- Dairy products — Schedule 4 dairy-specific GMP
- Meat and meat products — separate slaughter/processing standards
- Packaged drinking water — BIS + FSSAI dual compliance
- Infant food and formulas — Central License mandatory, additional testing
- Fishery and seafood products — MPEDA + FSSAI + export protocol
- Nutraceuticals and health supplements — Central License, product approval
Even if turnover is under ₹1.5 Cr, high-risk categories may require State/Central based on activity + food category.
